8. Trusts

Trusts are legal instruments whereby a person gives property to another person who holds that property on behalf of a third person. In the estate context you would leave property to a trustee who manages it for a beneficiary. Trusts are useful estate planning tools and are often created in wills. Should you wish to create one or more trusts for estate planning purposes we suggest that you contact our estates department as personal expert advice is a must.

The trusts that are capable of being set up here are relatively simple and are intended to safeguard a minor's or a young person's legacy (the trusts created are not simple but lack the precise planning required should they be intended as estate planning tools). The beneficiary of the trust need not be a minor; a testator or testatrix may leave property in trust until the beneficiary turns 25 or even older, most especially if the bequest is a large one and there is concern that a young beneficiary may not be able to adequately deal with the bequest until more mature.

Usually a minor cannot accept their legacy until reaching the age of 21 years. However you can specify that the legacy is to be received on the minor's behalf by their guardian and then it can be given to the beneficiary. Alternatively legacies can be left to trustees who are under a duty to care for them until such time as the beneficiary comes of age. When a legacy is held in trust it can be invested and the proceeds used to provide for a beneficiary which is particularly attractive where the beneficiary is a dependant.
